                <p n="1" xml:id="L0072-p-1"><term xml:id="L0072-term-d1e166">“Fornicatio”</term> serves as a generic term for any kind of extra-marital sexual intercourse (cf. <bibl corresp="https://id.salamanca.school/texts/W0014:5.3.52?format=html" xml:id="L0072-bibl-d1e169">Vitoria 1561, Sacr. Poen. q. Numerus, fol. 135v</bibl>, <bibl corresp="https://id.salamanca.school/texts/W0014:8.49?format=html" xml:id="L0072-bibl-d1e172">Sacr. matr. q. Crimen, fol. 203r</bibl>).</p>
                <p n="2" xml:id="L0072-p-2">So-called “simple fornication” (fornicatio simplex) means the sexual intercourse of an unwed woman and an unwed man between whom no impediment to marriage exists (<bibl corresp="https://id.salamanca.school/texts/W0002:16.1.number3?format=html" xml:id="L0072-bibl-d1e178">Azpilcueta 1556, cap. 16 no. 3, p. 159</bibl>, <bibl corresp="https://id.salamanca.school/texts/W0002:16.1.number1?format=html" xml:id="L0072-bibl-d1e181">cap. 16 no. 1, p. 158</bibl>; <bibl corresp="https://www.salamanca.school/data/W0017/html/00052_W0017-00-0287-d2-076a.html?q=fornicacion&amp;mode=edit#W0017-00-0287-pa-0f83" xml:id="L0072-bibl-d1e184">Albornoz 1573, lib. 4 prol., fol. 137v</bibl>;  <term xml:id="L0072-term-d1e189">matrimonium</term>). The restriction may thus be lost from sight among barbarian peoples as reported from the Americas (<bibl corresp="https://id.salamanca.school/texts/W0011:1.1.5.5.3" xml:id="L0072-bibl-d1e314">Soto 1553, lib. 1 q. 4 art. 5, p. 37</bibl>, <bibl corresp="https://id.salamanca.school/texts/W0011:1.3.1.2.3?format=html" xml:id="L0072-bibl-d1e317">lib. 3 q. 1 art. 2, p. 195</bibl>) or generally in the “mental fog” of mankind (“nebula mentium”: <bibl corresp="https://id.salamanca.school/texts/W0011:1.2.3.2.3?format=html" xml:id="L0072-bibl-d1e320">Soto 1553, lib. 2 q. 2 art. 2, p. 99</bibl>; “caligo mentis”: <bibl corresp="https://id.salamanca.school/texts/W0011:1.2.6.4.6?format=html" xml:id="L0072-bibl-d1e323">Soto 1533, lib. 2 q. q. art. 3, p. 166</bibl>).</p>
                    <p n="6" xml:id="L0072-p-6">The sexual union of man and woman is established by nature to beget children (<bibl xml:id="L0072-bibl-d1e329">Vitoria 1934, q. 57 art. 2 no. 4, p. 9</bibl>), who then have to be raised in a way fitting for an “animal rationale”. This requires the father’s involvement in the upbringing of his children (<bibl xml:id="L0072-bibl-d1e332">Vitoria 1934, q. 57 art. 2 no. 4, p. 9</bibl>), which is presumed impossible without a stable union between man and wife (<bibl corresp="https://id.salamanca.school/texts/W0003:22.1.2.1.3.10" xml:id="L0072-bibl-d1e335">Báñez 1594, comm. ad q. 78 art. 1, p. 583</bibl>; <bibl corresp="https://id.salamanca.school/texts/W0003:1.4.2.1.7" xml:id="L0072-bibl-d1e338">Báñez 1594, comm. ad q. 57 art. 3, p. 18</bibl>; <bibl corresp="https://id.salamanca.school/texts/W0003:22.1.2.1.3.10" xml:id="L0072-bibl-d1e341">Vitoria 1952, q. 100 art. 3, p. 455</bibl>). So fornication is a “nefarious crime” against the “fundament of procreation” (<bibl corresp="https://id.salamanca.school/texts/W0011:1.1.5.3.8" xml:id="L0072-bibl-d1e345">Soto 1553, lib. 2 q. 4 art. 3, p. 34</bibl>). Moreover, unchecked fornication would disturb the internal peace of any republic (<bibl corresp="https://id.salamanca.school/texts/W0003:22.1.2.1.3.10" xml:id="L0072-bibl-d1e348">Báñez 1594, comm. ad q. 78 art. 1, p. 583</bibl>).</p>
                    <p n="7" xml:id="L0072-p-7">With this classification, the Salamancans follow Aquinas and rebut medieval and modern authors like Durandus, Martinus de Magistris or Juan Caramuel Lobkowitz. The latter argue that simple fornication is neither against natural law nor inherently evil; therefore, it is not prohibited by its nature and can be considered evil only because of its prohibition in the Old and New Testament (<bibl xml:id="L0072-bibl-d1e354">Deut. 23:17, Ephes. 5:3-4: Caramuel 1652, no. 1171, pp. 565 sqq.</bibl>; <bibl xml:id="L0072-bibl-d1e357">Caramuel 1645, no. 1598, p. 409</bibl>; <bibl xml:id="L0072-bibl-d1e360">Durandus 1569, lib. 4 dist. 33 q. 2 no. 10, fol. 325v</bibl>; <bibl xml:id="L0072-bibl-d1e363">Martinus de Magistris 1511</bibl>; cf. <bibl xml:id="L0072-bibl-d1e366">Dedek 1980, 652 sqq.</bibl>; <bibl xml:id="L0072-bibl-d1e370">Armogathe 2008, p. 124</bibl>). The Salamancans vehemently reject these views (<bibl xml:id="L0072-bibl-d1e373">Vitoria 1952, q. 94 art. 2. no. 2, p. 147</bibl>) as dangerous and close to heresy (<bibl corresp="https://id.salamanca.school/texts/W0003:22.1.2.1.3.11" xml:id="L0072-bibl-d1e376">Báñez 1594, comm. ad. q. 78 art. 1, p. 584</bibl>; <bibl corresp="https://id.salamanca.school/texts/W0006:vol1.1.1.5.article8?format=html" xml:id="L0072-bibl-d1e379">Covarrubias 1571, vol. 1, In Quart. Libr. Decret., cap. 4 no. 8, p. 8</bibl>; for <bibl corresp="https://www.salamanca.school/data/W0017/html/00052_W0017-00-0287-d2-076a.html?q=fornicacion&amp;mode=edit#W0017-00-0287-pa-0f83" xml:id="L0072-bibl-d1e382">Albornoz 1573, lib. 4 prol., fol. 137v</bibl> the presumed licitness of fornication is the characteristic error of heathens and Muslims). Avendaño also rejects the licitness of fornicatio but deems the discussion too abstract to be of interest for the practical purpose of guiding consciences (<bibl corresp="https://id.salamanca.school/texts/W0001:vol3.1.12.4.7.2.section556" xml:id="L0072-bibl-d1e385">Avendaño 1675, vol. 3, p. 1 add. 4 § 3 no. 556, p. 140</bibl>).</p>
                    <p n="8" xml:id="L0072-p-8">Natural law and piety oblige a man to raise a child born out of fornication; if he tricked the woman into sex, e.g. by falsely promising marriage, paying alimony is also demanded by  <term xml:id="L0072-term-d1e393">iustitia commutativa</term>: pregnancy, birth, and the sustenance of the child were considered damage unjustly suffered by the deceived woman (<bibl corresp="https://id.salamanca.school/texts/W0003:6.2.2.2.1.83?format=html" xml:id="L0072-bibl-d1e396">Báñez 1594, comm. ad q. 62 art. 2, p. 191</bibl>).</p>
                    <p n="9" xml:id="L0072-p-9">Fornication is also prohibited by divine law (<bibl xml:id="L0072-bibl-d1e403">Vitoria 1952, q. 94 art. 2 no. 2, pp. 145 sq.</bibl>; <bibl corresp="https://id.salamanca.school/texts/W0001:vol3.1.12.4.7.2.section556" xml:id="L0072-bibl-d1e406">Avendaño 1675, vol. 3, p. 1 add. 4 § 3 no. 556, p. 140</bibl>) even though not explicitly mentioned in the Ten Commandments (<bibl corresp="https://id.salamanca.school/texts/W0011:1.2.6.4.6?format=html" xml:id="L0072-bibl-d1e409">Soto 1553, lib. 2 q. 5 art. 3, p. 166</bibl>): the latter prohibit only sins directly detrimental to other persons (e.g. adultery), leaving the basic moral education to figures of authority such as secular rulers and fathers (<bibl corresp="https://id.salamanca.school/texts/W0011:1.2.4.11.3?format=html" xml:id="L0072-bibl-d1e412">Soto 1553, lib. 2 q. 3 art. 11, pp. 128 sq.</bibl>). Under no circumstances can fornication be licit, not even when recommended by a doctor for health reasons (<bibl corresp="https://id.salamanca.school/texts/W0096:vol1.3.6.section74?format=html" xml:id="L0072-bibl-d1e415">Solórzano Pereira 1629, lib. 3 cap. 6 no. 74, p. 719</bibl>).</p>
                </div>
                <div type="subsection" n="2.2" xml:id="Toc193276578">
                    <head xml:id="L0072-he-d1e422">2.2 Simple fornication and human law</head>
                    <p n="10" xml:id="L0072-p-10">Positive human law does not forbid simple fornication but only its aggravated forms like incest, rape or adultery (<bibl corresp="https://id.salamanca.school/texts/W0011:1.1.7.3.3?format=html" xml:id="L0072-bibl-d1e428">Soto 1553, lib. 1 q. 6 art. 3, p. 49</bibl>). Even though all fornication is a mortal sin (see 2.3) and an ugly misdemeanour, the  <term xml:id="L0072-term-d1e433">respublica</term> allows simple fornication for the sake of avoiding greater sins like adultery (<bibl corresp="https://id.salamanca.school/texts/W0007:2.12.5?format=html" xml:id="L0072-bibl-d1e436">Mercado 1569, Opusculo de Cambios, cap. 11, fol. 113r</bibl>), thus illustrating the rule that between two inevitable evils that are similar in nature, the lesser one has to be chosen (<bibl corresp="https://id.salamanca.school/texts/W0017:2.17.8.3.4?format=html" xml:id="L0072-bibl-d1e439">Albornoz 1573, lib. 2 tit. 16 Adnot. Estancos, fol. 73v</bibl>).</p>
                    <p n="11" xml:id="L0072-p-11">Capital punishment would be considered excessive for simple fornication (<bibl xml:id="L0072-bibl-d1e445">Vitoria 1952, fragm. 2 concl. 13, p. 509</bibl>), but could be regarded as appropriate for qualified cases like incest or rape (<bibl corresp="https://id.salamanca.school/texts/W0033:4.7?format=html" xml:id="L0072-bibl-d1e448">Carrasco del Saz, tract. 4 no. 5, fol. 56r</bibl>).</p>

                <div type="subsection" n="2.3" xml:id="Toc193276579">
                    <head xml:id="L0072-he-d1e455">2.3 Fornication as a mortal sin</head>
                    <p n="12" xml:id="L0072-p-12">Fornication is considered almost inevitable: “among all the battles of the Christians, the hardest are those of chastity where the fight is a daily one, and victory very rare” (<bibl xml:id="L0072-bibl-d1e461">Granada 1792, lib. 2 cap. 6, p. 311</bibl>). It is thus regarded as one of the most common sins: “few can be found free from the vice of incontinence” (<bibl corresp="https://id.salamanca.school/texts/W0041:1.73?format=html" xml:id="L0072-bibl-d1e464">Díaz de Luco 1554, cap. 73, p. 148</bibl>; see <bibl corresp="https://id.salamanca.school/texts/W0011:1.2.4.11.3?format=html" xml:id="L0072-bibl-d1e467">Soto 1553, lib. 2 q. 3 art. 11, p. 129 sq.</bibl>). Nevertheless, any kind of fornication is a mortal sin, including the fornicatio simplex (<bibl corresp="https://id.salamanca.school/texts/W0041:1.73?format=html" xml:id="L0072-bibl-d1e470">Victoria 1952, q. 94 art. 2 no. 2, pp. 145 sqq.</bibl>; <bibl corresp="https://id.salamanca.school/texts/W0002:16.1.number1?format=html" xml:id="L0072-bibl-d1e473">Azpilcueta 1556, cap. 16 no. 1, p. 158</bibl>, <bibl corresp="https://id.salamanca.school/texts/W0002:16.2.2?format=html" xml:id="L0072-bibl-d1e477">cap. 16 preg. no. 4, p. 162</bibl>). The authors are perfectly aware that for laypersons, this is difficult to understand or accept (<bibl corresp="https://id.salamanca.school/texts/W0041:1.73?format=html" xml:id="L0072-bibl-d1e480">Vitoria 1932, q. 2 art. 10 no. 3, p. 83</bibl>; <bibl corresp="https://www.salamanca.school/data/W0017/html/00052_W0017-00-0287-d2-076a.html?q=fornicacion&amp;mode=edit#W0017-00-0287-pa-0f83" xml:id="L0072-bibl-d1e483">Albornoz 1573, lib. 4 prol., fol. 138r</bibl>), but the laity cannot be expected to know how to measure the relative gravity of different sins (<bibl corresp="https://id.salamanca.school/texts/W0014:5.2.15?format=html" xml:id="L0072-bibl-d1e486">Vitoria 1561, Sacr. Poen., q. An de maiori, fols. 88v sq.</bibl>). To convey this gravity to them is a challenging task for missionaries and confessors (see <bibl corresp="https://id.salamanca.school/texts/W0041:1.73?format=html" xml:id="L0072-bibl-d1e489">Schwartz 1997</bibl>).</p>
                    <p n="13" xml:id="L0072-p-13">Fornication relates to the deadly sin of luxuria (<bibl xml:id="L0072-bibl-d1e495">Granada 1792, lib. 2 cap. 6, p. 311</bibl>). Soto sees it not only as a sin against temperance but also against justice: fornication is committed against a person, viz. the child conceived in the extra-marital intercourse even if it only exists in potentiality (<bibl corresp="https://id.salamanca.school/texts/W0011:1.5.4.3.4?format=html" xml:id="L0072-bibl-d1e498">Soto 1553, lib. 5 q. 3 art. 3, p. 421</bibl>), “for, generally speaking, a child born of uncertain parentage cannot be easily brought up properly” (<bibl corresp="https://id.salamanca.school/texts/W0011:1.5.11.3.2?format=html" xml:id="L0072-bibl-d1e501">Soto 1553, lib. 5 q. 10 art. 3, p. 491</bibl>).</p>
                    <p n="14" xml:id="L0072-p-14">Fornication is committed when a person engages in a sexual act with a non-marital partner willingly. Only continuous objection against the act can excuse from the sin. This can take the form of silent internal protest; verbal or physical resistance is not required (<bibl corresp="https://id.salamanca.school/texts/W0002:16.1.number1?format=html" xml:id="L0072-bibl-d1e507">Azpilcueta 1556, cap. 16 no. 1, pp. 158 sq.</bibl>). Also, experiencing sexual arousal does not constitute agreement: as a natural function of the body, physical pleasure is not under rational control and thus cannot cancel out the opposing will (<bibl corresp="https://id.salamanca.school/texts/W0002:16.1.number1?format=html" xml:id="L0072-bibl-d1e510">Azpilcueta 1556, cap. 16 no. 1, p. 158</bibl>). The best safeguard against the sin of fornication is lifelong chastity (<bibl corresp="https://id.salamanca.school/texts/W0002:23.22.number112?format=html" xml:id="L0072-bibl-d1e513">Azpilcueta 1556, cap. 23 no. 112 , pp. 489 sq.</bibl>) and watchfulness against any kind of temptation (<ref>Granada 1792, lib. 2 cap. 6, par. 1, pp. 314-318</ref>).</p>

The medieval discussion of determining a hierarchy of sins according to their gravity, however, is not taken up. Although Vitoria leans towards the opinion of Aquinas (that fornication is less grave than theft, homicide, or murder: <bibl xml:id="L0072-bibl-d1e570">Vitoria 1934, q. 66 art. 6 no. 3, pp. 336 sq.</bibl>), he explicitly leaves the question open (<bibl xml:id="L0072-bibl-d1e574">Vitoria 1952, q. 94 art. 3, p. 149</bibl>), while Soto warns against simplistic comparisons (<bibl corresp="https://id.salamanca.school/texts/W0011:1.5.4.3.5?format=html" xml:id="L0072-bibl-d1e577">Soto 1553, lib. 5 q. 3 art. 3, p. 421</bibl>).</p>
                    <p n="16" xml:id="L0072-p-16">Sexual sins were considered especially difficult to treat in confession because of the reticence of the confessants (<bibl xml:id="L0072-bibl-d1e584">Arcuri 2018, 83</bibl>). The confessor should strive to build trust, advises Baltasar de Rienda, a parish priest in the province of Granada: without a complete confession, the spiritual medicine of absolution cannot be administered (<bibl xml:id="L0072-bibl-d1e587">Rienda 1662, fol. 33v</bibl>). However, the confessor should only pose the questions necessary to assess the type of fornication, simplex or other (<bibl corresp="https://id.salamanca.school/texts/W0002:16.1.number4?format=html" xml:id="L0072-bibl-d1e590">Azpilcueta 1556, cap. 16 no. 4, p. 161</bibl>). The precise number of occurrences is not required (<bibl corresp="https://id.salamanca.school/texts/W0014:5.3.52?format=html" xml:id="L0072-bibl-d1e593">Vitoria 1561, Sacr. Poen. q. Numerus, fol. 135v</bibl>). Azpilcueta warns against inquiring in too much detail, as this endangers the confessor himself as well as the penitent (<bibl corresp="https://id.salamanca.school/texts/W0002:16.1.number4?format=html" xml:id="L0072-bibl-d1e596">Azpilcueta 1556, cap. 16 no. 4, p. 161</bibl>). Taking communion after an unconfessed fornication is highly irreverent, but no mortal sin in itself (<bibl corresp="https://id.salamanca.school/texts/W0014:4.28?format=html" xml:id="L0072-bibl-d1e600">Vitoria 1561, Sacr. Euch. q. An pollutio, fol. 56r</bibl>).</p>

                    <head xml:id="L0072-he-d1e607">2.4 Fornication and clerics</head>
                    <p n="17" xml:id="L0072-p-17">According to the majority of canonists, all clerics can commit simple fornication (see <bibl corresp="https://id.salamanca.school/texts/W0041:1.72.1" xml:id="L0072-bibl-d1e613">Díaz de Luco 1554, cap. 72, p. 144</bibl> for details of authors and arguments). The opinion that bishops and prelates are “married” to their titular churches and therefore invariably commit adultery when engaging in sexual intercourse is deemed probable, but rejected (<bibl corresp="https://id.salamanca.school/texts/W0041:1.72.1" xml:id="L0072-bibl-d1e616">Díaz de Luco 1554, cap. 72, p. 144</bibl>). Soto, however, points out that fornicating clerics violate their vow of chastity and thus commit a twofold sin (<bibl corresp="https://id.salamanca.school/texts/W0011:2.3.4.2.3?format=html" xml:id="L0072-bibl-d1e619">Soto 1553, lib. 8 q. 4 art. 2, p.</bibl>).</p>
                    <p n="18" xml:id="L0072-p-18">Clerics are to be punished when their sexual relationship with a woman causes a  <term xml:id="L0072-term-d1e627">scandalum</term>. The severity of the sanction is at the discretion of the ecclesiastical judge, who should take all circumstances into account (<bibl corresp="https://id.salamanca.school/texts/W0041:1.73?format=html" xml:id="L0072-bibl-d1e630">Díaz de Luco 1554, cap. 73, p. 148</bibl>). Notoriety, such as caused by the cleric living together with a woman as man and wife and publicly raising his children (<bibl corresp="https://id.salamanca.school/texts/W0041:1.73?format=html" xml:id="L0072-bibl-d1e633">Díaz de Luco 1554, cap. 73, p. 146</bibl>), leads to the cleric’s irregularity (<bibl corresp="https://id.salamanca.school/texts/W0003:8.8.2.1.5.3" xml:id="L0072-bibl-d1e636">Báñez 1594, comm. ad q. 64 art. 8, p. 375</bibl>). For more discreet cases, a mild punishment is deemed sufficient because of the ubiquity of the sin (<bibl corresp="https://id.salamanca.school/texts/W0041:1.73?format=html" xml:id="L0072-bibl-d1e640">Díaz de Luco 1554, cap. 73, p. 148</bibl>). However, fornication with a nun is considered sacrilege, adultery and incest; the sanctions for the cleric include deposition and banishment to a monastery (<bibl corresp="https://id.salamanca.school/texts/W0002:16.1.number3?format=html" xml:id="L0072-bibl-d1e643">Azpilcueta 1556, cap. 16 no. 3, p. 160</bibl>; <bibl corresp="https://id.salamanca.school/texts/W0041:1.75?format=html" xml:id="L0072-bibl-d1e646">Díaz de Luco 1554, cap. 75, p. 157</bibl>).</p>

                <p n="19" xml:id="L0072-p-19">In the research literature, a lot of attention has been paid to the attempts of the medieval and early modern Catholic church to regulate the sexual life of the faithful (e.g. <bibl xml:id="L0072-bibl-d1e660">Arcuri 2018</bibl>; <bibl xml:id="L0072-bibl-d1e663">Cova 2002</bibl>; <bibl xml:id="L0072-bibl-d1e666">Nirenberg 2002</bibl>; <bibl xml:id="L0072-bibl-d1e669">Finch 1996</bibl> for Normandy), whereas the practices of ecclesiastical courts in these case remain largely unexplored (but see <bibl xml:id="L0072-bibl-d1e672">Lesthaeghe 1989</bibl> for the Spanish Netherlands). Simple fornication has also received less attention than more specific topics such as adultery, prostitution (<bibl xml:id="L0072-bibl-d1e676">Ratcliffe 1984</bibl>), same-sex relationships (<bibl xml:id="L0072-bibl-d1e679">Velasco 2010</bibl>), seduction and rape (<bibl xml:id="L0072-bibl-d1e682">Sampson 2018</bibl>) and other “sins of the flesh” (<bibl xml:id="L0072-bibl-d1e685">Pastor 2015</bibl>). However, the study of <bibl xml:id="L0072-bibl-d1e688">Schwartz 1997</bibl> offers insights into the theological and practical handling of the fornicatio simplex in the colonial context of the Iberian empires.</p>
